Actual Breach of Contract & Anticipatory Breach of Contract
When there is an actual breach of contract, one of the parties in the contract refuses to fulfill his side of the contract or completely fails to perform. In contrast, an anticipatory breach occurs when one of the parties announces in advance the he intends to not fulfill his part of the contract. In both of the above types of breaches, the innocent party may request damages.
Minor Breach of Contract & Material Breach of Contract
A minor breach of contract occurs when one party in the contract fails to deliver some part of the contract (even if the main part of the contract was delivered) or violates some term of the contract (item delivered late, wrong color, etc.). On the other hand, a material breach is a much more serious breach of contract. For example, if a completely different item was delivered than was agreed upon, that would constitute a material breach of contract.
Expectation & Consequential Compensatory Damages
